Description: On or about February 25, 2014, Plaintiff was a lawful operator of a Lexus motor vehicle which was loaned to him by the Lexus repair shop to use during his car’s repairs. The Plaintiff’s vehicle was stopped by defendant officers, including Officer Baptiste. Plaintiff was ordered to exit the vehicle and present identification; he presented a valid New York driver’s license to the defendants. Plaintiff was immediately searched by the defendant officers and then cuffed and told that he was under arrest for a suspended license. Plaintiff spent approximately 24 hours in custody at the 23rd precinct. The district attorney declined to prosecute Plaintiff and he was released from custody without being arraigned. Plaint...
