Description: On August 3, 2019, at approximately 11:00 a.m. at the Apple Store, Queens Center Mall, Queens New York, Christopher Battaglia was unlawfully arrested for possession of a knife. The knife was inside a holster and was not in plain view. Thus, he was unlawfully stopped and searched. The knife blade was under four inches and requires two hands to open, making it a lawful knife. At arraignment, Mr. Battaglia accepted an ACD. The case was dismissed and sealed on November 15, 2019. Christopher Battaglia was incarcerated for approximately 12 hours. NYPD officers placed handcuffs too tightly on his wrists and he suffered red mars and abrasions.

Description: On August 16, 2019 at approximately 10:00 PM outside of 156-71 Cross Bay Boulevard, in the borough of Queens, plaintiff was approached by police officers. More specifically, he was arrested for assault and harassment by police officer John Digiaimo, unidentified police officer (John Doe 1) and unidentified police officers (John Does 2-12). Plaintiff had been engaged in a (physical) dispute with a certain Mr. Said, upon which both plaintiff and Mr. Said were arrested. Video surveillance existed inside the restaurant but officers made no attempt to view it before or after arresting plaintiff.
