Description: On or about July 2, 2012, Plaintiff John O'Malley spent the day biking and was still wearing his biking gear and cleats as he walked along his bike talking to a friend on his way home. At approximately 12:30am in the UWS, a police car overheard a comment by O'Malley that police were lazy a**ho*** always looking to harass people. Police car made a u-turn. An officer got out and asked "what did you say." An argument ensued. Plaintiff called 911. Several cars showed up. Refusing to give ID until told what law he broke, SGT BRENNAN and another officer took plaintiff to the ground, breaking his wrist in the process and scraping his knee.
