Description: On or about August 9, 2020, Plaintiff Jude Samson was lawfully traversing through John J. Burns Park in Massapequa, New York when, suddenly and with no warning or provocation whatsoever on his part, Samson was violently confronted by NYPD Officer Nicholas Gericitano. Gericitano demanded that Samson leave the park, which prompted Samson to begin recording the incident with his cell phone. Gericitano lunged at Samson, grabbed the phone from his hands, and threw it. He then began forcibly shoving Samson and threw Samson to the ground. While Samson laid helplessly on the ground, Gericitano got on top of him and severely beat him across the face and body.
