Summary

[redacted] stated that on December 27, 2000, he was at the Great Wall Chinese Restaurant located at 45th Street and 5th Avenue in Brooklyn with his cousin, [redacted] and two friends, [redacted] and [redacted]. [redacted] and [redacted] left the restaurant between 10:00 and 10:30 PM, approximately five minutes before [redacted] and [redacted]. [redacted] and [redacted] decided to play a game on [redacted] and [redacted] and went to [redacted] which is the home of [redacted], [redacted]'s mother and [redacted] and [redacted]'s grandmother.
The house at [redacted] is a three-story house. At ground level there is the entrance into the basement apartment. There are stairs located to the right of the door to the basement apartment. These stairs lead up to the main entrance of the house. Once inside the door to the main entrance, there is a hallway that leads to stairs, which go down into the basement apartment. Thus the basement can be accessed either from outside, or inside of the house.
[redacted] took [redacted]'s BB gun, and [redacted] and [redacted] stood on the stoop. When [redacted] and [redacted] came around the corner, [redacted] pointed the gun at [redacted] and fired. [redacted] did not know there was a BB in the gun. The BB hit the metal gate of a store and fell to the ground. A man, identified as Det. Mohr from police documents obtained by [redacted]'s mother, started to run toward [redacted] with a gun. [redacted] had not seen Det. Mohr when he first fired the gun. [redacted] did not know that Det. Mohr was a police officer at this time.
[redacted] and [redacted] ran into the main entrance of the house, and [redacted] slammed the door behind them.
