Summary

Sometime between 4:00 p.m. and 4:30 p.m., an "unmarked, tinted, police vehicle" pulled up to the vehicle. Four police officers, dressed in plainclothes, came out from the police vehicle and approached [redacted] observed the officers questioning [redacted] He approached them and asked, "What's going on?" One officer, whom [redacted] described as a White male, 5' 7", about 170 pounds with a mustache, replied that they received a call about a male sleeping in the vehicle for several hours. [redacted] told the officers that the car was in his care. At some point during their interaction, the above-described officer saw a pair of shorts in the trunk of the car. (The report did not state how the trunk of the vehicle came to be open.) The officer asked [redacted] if the shorts belonged to him and asked if he could search the [redacted] shorts. [redacted] asked, "Am I under arrest?" The officer replied, "No." [redacted] then objected to him searching his shorts and the officer "yanked" the shorts from [redacted] hands. [redacted] told the officer that he was going to call his lawyer. One officer replied, "You could call whoever the fuck you want." (Allegation A.) At that time, [redacted] observed that his shorts were placed in the trunk of the car. [redacted] went to the 32nd precinct's stationhouse to file a civilian complaint.
