On May 2nd, 2002 at around 6:30pm [redacted] was at his house. He left and started a load of laundry at the Laundromat on the block. As he was waiting for the laundry he crossed the street to [redacted] his cousin's building. [redacted] cousin is [redacted]. [redacted] asked three kids who were playing on the stairs to ring the buzzer for apartment [redacted]. [redacted] waited and [redacted] called out over the intercom asking if it was [redacted] who had rung the buzzer. As a marked police van pulled up, [redacted] responded to [redacted] by yelling "yo!" PO Gibbs jumped out of the police van and instructed [redacted] to put his hands up against the wall. As [redacted] complied, PO Gibbs pushed [redacted] head, with two hands, so that the left side of [redacted] face hit the wall. At that time, [redacted] came out of the apartment. He was also handcuffed and put up against the wall. The second officer assisted PO Gibbs by lifting up [redacted] arms from behind and twisting them before handcuffing [redacted]. [redacted] did not resist. After he was handcuffed he was told to get down on the ground. He kneeled and then PO Gibbs kicked him in the right leg. As he went down to the ground, he scraped his hand on the sidewalk. [redacted] crumpled to the ground. PO Gibbs searched and frisked him. He was unsure whether [redacted] was also searched and frisked.
He was then taken to the precinct by PO Gibbs. His cousin was released at the scene. [redacted] remained at the precinct for about half an hour. PO Gibbs then removed [redacted] from the cell and asked him if he knew why he had been arrested. [redacted] said he did not. PO Gibbs accused him of being a lookout for a drug operation. PO Gibbs used profanity, saying "Don't fucking play with me. I'll punch your fucking mouth." PO Gibbs made other statements such as "I don't want to fucking see you in this precinct again. If I find out that you are a lookout I'm going to punch you in the face." PO Gibbs made these statements in the cell when there were no witnesses...
