Minutes prior to the incident, the complainant observed his friend's black, two-door Honda Civic, parked at the curb in front of a fire hydrant. His friend, [redacted] was seated in the passenger seat looking in the glove compartment. [redacted] opened the driver's door and sat in the driver's seat. After closing the driver's door, the two talked. The engine of the car was turned off and the keys were not inside the ignition. Within minutes, an officer later identified as PO Timothy Skretch, tapped on the driver's door window and [redacted] opened the window. The officer requested [redacted] driver's license and registration. [redacted] responded saying that he was not driving the vehicle, but PO Skretch ordered [redacted] out of the vehicle. [redacted] complied and the officer ordered [redacted] to walk towards the back of the vehicle and place his hands against the car. [redacted] complied and the officer subsequently searched [redacted] placing his hands inside the pockets of [redacted] shorts. During the one-minute search, the officer removed [redacted] wallet. While he was searched, [redacted] observed that [redacted] had exited the vehicle and stood beside the passenger side of the vehicle. He did not observe any officer frisk or search [redacted] After searching [redacted] PO Skretch, using a flashlight searched the driver's seat of the vehicle, underneath the seat, and then pulled the driver's seat forward to search the back seat. The search of the vehicle revealed no contraband or weapons and PO Skretch then handed [redacted] wallet to an another plainclothes officer, identified as PO Villaneuva. PO Villanueva entered an unmarked police van, which was parked behind the vehicle and after two-minutes the officer returned to the Honda Civic and spoke with PO Skretch.
