Summary

At approximately 9:30 PM on June 19, 2004, PO Biju Mathew, PO Nelson Mathew and PO Randolff Pinard responded to [redacted] in Queens, because there was a party at the location and the officers received numerous "loud music" complaints from 311. [redacted] approached the officers and told them that his sister was the homeowner but that she was not present. The officers informed [redacted] that they were responding to noise complaints, and asked to see his identification. PO Biju Mathew allegedly grabbed [redacted] by the neck (Allegation A). [redacted] PO Biju Mathew allegedly threatened a group of civilians with his nightstick (Allegation B). [redacted] PO Biju Mathew and additional unidentified officers allegedly drew their guns (Allegations C and D). [redacted] PO Biju Mathew, PO Nelson Mathew, PO Anthony Salato and additional officers entered and searched the private house at the incident location (Allegations E, F, G and H). [redacted] PO Brendan Parpan allegedly entered the location and hit [redacted] with his nightstick (Allegations I and J). [redacted] PO Nelson Mathew allegedly said, "I don't give a fuck about your Christening. Shut the fuck up and get the fuck out of my way" (Allegation K). [redacted] PO Biju Mathew allegedly pepper sprayed [redacted] (Allegation L). [redacted] PO Biju Mathew and additional unidentified officers used physical force to effect the arrest of [redacted] on the front steps of the location (Allegations M and N). [redacted] was also arrested in connection with the incident, and PO Anthony Salato and additional unidentified officers used physical force to effect his arrest (Allegations O and P). [redacted] who lives next door to the incident location, allegedly asked an officer for his identification and the officer allegedly refused to provide it (Allegation Q). PO Brendan Parpan and additional unidentified officers used force to effect the arrest of [redacted] (Allegations R and S).
