Summary

[redacted] stated that at approximately 2:15 p.m. on January 16, 2005 he was waiting for a haircut at Victor's barbershop located on 223rd Street and Linden Boulevard in Queens. Also present in the barbershop were three barbers; [redacted] a mentally disabled customer named [redacted] and four to five additional patrons. While waiting in the barbershop an officer in uniform, PO1, described by [redacted] as a white male officer, 5'6", stocky build, in his thirties, with short brown hair, identified by shield number as PO Anthony Salato, entered the barbershop. PO Salato pointed at [redacted] and stated, "You come here." [redacted] complied and went outside with PO Salato and provided his driver's license to him. A few minutes later, [redacted] returned to the barbershop. A second officer, PO2, described by [redacted] as a white male officer, in uniform, slim, identified by the CCRB as PO Robert Rizzotto, waited by the door of the barbershop while PO Salato spoke to [redacted] stated that PO Rizzotto did not interact with him or the patrons of the barbershop. A third officer, PO3, described as a white male officer in uniform, identified by the CCRB as PO Shawn Gallagher, remained outside of the barbershop by an unmarked green Chevy Impala. Approximately three to five minutes later PO Salato returned to the barbershop and informed [redacted] that he was going to be arrested but did not provide a reason why. PO Salato handcuffed [redacted] and escorted him outside. [redacted] and those present in the barbershop followed them outside. [redacted] asked [redacted] if he wanted him to call his mother to which he stated that he did. As [redacted] was walking to his car, he observed PO Salato push [redacted] into the backseat of the police car. [redacted] stated that [redacted] was not resisting arrest. [redacted] obtained a piece of paper and a pen out of his car, which was parked in front of the barbershop. [redacted] asked PO Salato for his badge number to which he did not respond.
