On March 3, 2005 at approximately 8:00pm, [redacted] and [redacted] were returning home from work in [redacted]'s vehicle, which is a white Escalade. [redacted] and [redacted] were in the Bronx on East 167th Street and Simpson Street when Officer Angel Vasquez and Lt. Deodat Urprasad saw them. Officer Vasquez and Lt. Urprasad had been provided with a picture of an individual wanted for a shooting that took place approximately a week and a half before the incident, and Officer Vasquez noticed that the vehicle matched the description. Officer Vasquez attempted to pull up next to [redacted] to see if he matched the description of the shooter but the traffic light turned green and [redacted] took off at a high rate of speed. Lt. Urprasad instructed Officer Vasquez to pull [redacted] over (allegation A) to conduct an investigation.
[redacted] pulled over and Officer Vasquez approached the driver's side window, while Lt. Urprasad approached the passenger side. Officer Vasquez requested [redacted]'s license and registration several times but [redacted] refused to cooperate until Officer Vasquez informed him of the reason for stopping him. Lt. Urprasad, who was on the passenger side, observed [redacted] fidgeting and instructed [redacted] to exit the vehicle several times but [redacted] allegedly, did not comply. Lt. Urprasad drew his weapon and pointed it at [redacted] (allegation B) and instructed him to get out of the vehicle, at which time [redacted] complied. Lt. Urprasad allegedly instructed [redacted] to turn the "fucking car off" (allegation C). [redacted] complied and exited the vehicle as well. As [redacted] and [redacted] stood at the rear of the vehicle, a friend of [redacted]'s, by the name of [redacted] approached them and asked the officers what was going on.
