On May 22, 2005, at approximately 10:00 PM, [redacted] and [redacted] were exiting the rear entrance to [redacted] where [redacted] resides in apartment # [redacted] There was a report for two Hispanic males with guns on the [redacted] of the building. Lt. Luke Anderson was the first officer to respond, followed by PO Joseph Flynn and PO Frederick Drone of the 60th Precinct. [redacted] exited the building first, and Lt. Anderson shined a flashlight in his face threw him onto the ground (allegation A), and pointed his gun at him (allegation B). [redacted] stepped back inside the building. PO Drone and PO Flynn entered the building to look for [redacted] PO Thomas Franklin, PO Mercedes Sandoz and PO Monique Lewis, officers from PSA1, then arrived to the scene.
Inside the rear of the building, PO Drone handcuffed and pointed his gun in [redacted]'s face (allegation C). PO Drone patted down [redacted] (allegation D). PO Drone searched [redacted] removing his keys from his pockets (allegation E). PO Flynn patted down [redacted] and searched [redacted] removing his keys, phone and money from his pockets (allegation F and G). The officers then asked [redacted] and [redacted] for ID. Several officers went upstairs to verify [redacted] residence. [redacted] exited the building with officers to receive a summons [redacted] PO Franklin threatened to kill [redacted] at his house (allegation H). PO Franklin then searched [redacted]'s pockets again (allegation I). [redacted] was released from his handcuffs and permitted to leave. [redacted] called the CCRB on his cell phone at the scene before filing a complaint at PSA1 with [redacted]
