Summary

On June 4, 2005 at approximately 4:15 PM, [redacted] was in his apartment located at [redacted] in Queens. [redacted] heard knocking at his door, and when he opened it he saw four officers standing outside of his apartment. Two of the officers were identified as Officer Anthony Salato and Officer Joseph Durante. All four officers had their guns drawn and pointed at [redacted] (allegations A, B, and C). An officer instructed [redacted] to put his hands in the air and [redacted] complied. Officer Salato and Officer Durante immediately ran into his apartment (allegations D and E). An unidentified officer placed [redacted] in handcuffs and escorted him into the hallway. Officer Salato then frisked [redacted] (allegation F). [redacted] noticed four additional unidentified officers in the stairwell of the building. After approximately fifteen to twenty minutes, Officer Salato and Officer Durante exited [redacted] s apartment.
