Summary

On June 14, 2005, [redacted] returned to his home at [redacted] in Brooklyn and saw that it was on fire. At the time when [redacted] arrived, there were already numerous police officers and firefighters at the scene. Out of concern for his family's safety, [redacted] rushed up the steps to the front doors of the building and saw that firefighters were attempting to remove an injured person. A plainclothes officer said, "What the fuck are you doing, get the fuck out of here," and later added, "If you want to be a fucking hero, go to fucking Iraq" (allegation A). This officer then struck [redacted] in the head with a radio (allegation B). [redacted] turned away, and this officer struck [redacted] in the head with a radio for the second time. A uniformed officer in the area then struck [redacted] with an asp to his chest and back (allegation C), as other officers pulled [redacted] off of the steps. The officers took [redacted] to the ground, and they allegedly struck him approximately ten additional times (allegations D, E, F, and G). The officers handcuffed [redacted] stood him up, and transported him to the station house. While inside the patrol car, one of the officers told [redacted] to "shut the fuck up" (allegation H). At the station house, one of the officers asked [redacted] if he needed medical attention. Before [redacted] could respond, this officer said, "fuck it, you don't need medical attention" (allegation I). After [redacted] was arrested and removed from the scene, his sister-in-law, [redacted] also tried to enter the burning building.
