On July 12, 2005 at approximately 7:30 p.m., [redacted] and [redacted] were sitting on the front stoop of [redacted]s home, which is located at [redacted] talking with [redacted]. At this time, [redacted]s young child was riding his tricycle with [redacted]s young child a driveway on the side of [redacted]. [redacted] the owner of the home located at [redacted] asked the adults to remove the children from the driveway. [redacted] PO Paulo Velasquez of the 114th Precinct, then exited [redacted]s home. Though PO Velasquez was off-duty and dressed in civilian clothes, he invoked his authority as a police officer by speaking to [redacted] and [redacted] and saying something along the lines of "Get the fuck out of here before you spend the night in jail" (Allegation A). PO Velasquez then became involved in an argument with [redacted] and [redacted] and told [redacted] to get his "white trash piece of shit wife" off [redacted] (Allegation B). PO Velasquez allegedly then punched [redacted] in the face causing [redacted] to fall to the ground (Allegation C). Once [redacted] was on the ground, PO Velasquez allegedly punched him repeatedly in the back of the head (Allegation D). [redacted] then jumped on PO Velasquez's back and began to strike him. PO Velasquez allegedly responded by punching [redacted] in the face causing [redacted] to fall to the ground. [redacted] then jumped on PO Velasquez's back once again. PO Velasquez allegedly responded by lifting her off the ground and pushing her away causing her fall onto her back (Allegation E). While PO Velasquez was struggling with [redacted] and [redacted] approached two police officers, later identified through this investigation as PO Edgar Gomez and PO Michael Perez of the 110th Precinct.
