On July 14, 2005, [redacted] left his son's residence at [redacted] in Brooklyn and began to walk down Pitkin Avenue. After stopping at a store to buy food, he proceeded toward the intersection of Pitkin Avenue and Rockaway Avenue. He was riding a bike in the street at the time, and as he approached the intersection, a gray SUV pulled in front of him, cutting him off. [redacted] rode up onto the sidewalk to avoid the vehicle, and got off his bike. As he did, he saw the passenger of the SUV (PO Christopher Castle of the Brooklyn North Narcotics Division) emerge and begin to walk toward him with his gun drawn [Allegation A and Allegation B]. PO Castle asked [redacted] where he was going, and [redacted] responded that he was on his way home from his son's house. PO Castle explained that he had stopped [redacted] because he had seen him pass something to another individual. [redacted] insisted that he had never passed anything to anybody. A second officer (Sgt. Roy Bocina of the Brooklyn North Narcotic's Division), the one who had been driving the car, soon approached [redacted] [Allegation C], and told him he had gotten out of the car because [redacted] was acting like an "asshole" [Allegation D]. PO Castle then proceeded to frisk and search [redacted] reaching into his pockets and socks [Allegation E]. As PO Castle did this, Sgt. Bocina took [redacted]s bike, examined it, and looked under the ripped seat cover [Allegation F].
