[redacted] alleges that on September 18, he was walking by the corner of West 49th Street and 7th Avenue in Manhattan, when he observed a street peddler, [redacted] with whom [redacted] had no prior relationship standing with his hands behind his back. [redacted] saw [redacted] fall onto his knees after being approached by Lt. John McAndrew but could not see with certainty whether Lt.
