Summary

On September 20, 2005 at approximately 8:30PM, [redacted] said hello to his friend [redacted] who was standing in front of Arcade Pizza pizzeria at the corner of 191st Street and St. Nicholas Avenue in Manhattan. PO Johanna Urena then told [redacted] to move away from his friend and went into a deli. [redacted] then decided to go to Arcade Pizza and as he left the deli PO Roberto Argaluza asked [redacted] "What you forgot what you were going to buy?" [redacted] continued to walk to Arcade Pizza and once inside the pizzeria was grabbed by PO Luis Sandoval (allegation A). PO Sandoval and PO Argaluza then brought [redacted] to the ground outside of the pizzeria (allegation B and C). PO Urena then approached [redacted] and asked him "Who's the motherfucker now (allegation D)?" PO Urena also called [redacted] a "pussy (allegation D)", and threatened to pepper spray [redacted] (allegation E). [redacted] was then transported to the precinct for arrest processing.
