On December 20, 2005, [redacted] went to Brothers Food Market located at 761 East 182nd Street in the Bronx to purchase a sandwich where [redacted] got into an argument with a store clerk over whether [redacted] had paid. The store clerk called 911 and Officer Flavio Rodriguez and an unidentified Hispanic male officer responded to the location. [redacted] alleged that PO Rodriguez approached him and without identifying himself as an officer instructed [redacted] to remove his hands from his pockets. PO Rodriguez then went into [redacted] Is two jacket pockets, two sweatshirt pockets and four pant pockets (Allegation A).
