Summary

On January 28, 2006, at approximately 9:30 p.m., [redacted] and additional children were playing outside of [redacted] in Queens when Sergeant Carlos Fabara, Officer Matthew Handelsman and Officer Eric Konoski drove past the location. Sergeant Fabara exited the vehicle, stopped [redacted] (Allegation A) and searched him (Allegation B). [redacted] alleged that Officer Konoski spoke discourteously to her, saying, "Shut the fuck up and mind your fucking business" (Allegation C) and used physical force against her by punching her and throwing her over a fence (Allegation D). [redacted] claimed that Officer Konoski spoke discourteously to [redacted] telling him to "mind his fucking business" (Allegation E) and that officers punched [redacted] and kneed him in the legs, causing him to fall to the ground (Allegation F). The officers transmitted a request for assistance and numerous officers, including Officer Nicholas Vandyke, responded to the location. [redacted] alleged that Officer Nicholas Vandyke pushed [redacted] against a wall and placed her in handcuffs (Allegation G).
