Summary

On February 2, 2006 at approximately 9:30 PM, [redacted] was walking in the vicinity of [redacted] when five male plainclothes officers stopped him (Allegation A). Among the officers present were later identified officers PO Orin Cox, Sgt. Norman Grandstaff, and Lt. Frank Kelly from the 70th Precinct. PO Cox, Sgt. Grandstaff, and two additional unidentified white male officers immediately approached [redacted] and punched him several times in the head and kicked him several times in the legs (Allegations B and C). [redacted] moved to a nearby fence and an unidentified officer reached his arm around [redacted] s neck from behind and restricted his breathing (Allegation D). [redacted] was punched approximately twenty more times and kicked by PO Cox and the other officers causing him to fall backwards onto the officers. During this interaction, [redacted] tore his jacket (Allegation E). [redacted] was then handcuffed and two officers dragged him to an unmarked car. First an officer and then PO Cox searched [redacted] also striking him several more times in the face. [redacted] did not say anything to the officers at this time. [redacted] s cousin, [redacted] then arrived at the scene and asked the officers what was happening. An unidentified plainclothes officer told [redacted] to move away or he would be arrested, which he did (Allegation F). This same officer then frisked [redacted] (Allegation G).
