At about 7:20 PM on February 16, 2006, [redacted] exited a restaurant located on West 116th Street in Manhattan and observed an officer, later identified as PO George Couluris of the 28th Precinct, in the process of issuing a [redacted] summons to his vehicle. [redacted] stated he asked PO Couluris not to issue the summons and PO Couluris obliged, at which point he got in his vehicle and drove away from the location. PO Couluris stated [redacted] sped away from the location while he was in the process of issuing the summons. PO Couluris and his partner, PO James Nagle, pursued [redacted] vehicle. Both vehicles stopped at the intersection of West 116th Street and 5th Avenue. Sgt. Thomas Alps, also of the 28th Precinct, arrived at the location. [redacted] alleged that PO Couluris and PO Nagle exited their vehicle and approached him with their guns pointed (Allegations A and B).
