Summary

On April 7, 2006, [redacted] and [redacted] were at [redacted] Bar on Harmon and Myrtle Avenues in Brooklyn when Sgt. John Zegilla, PO Ronald Perez, PO Kirk Fernandes and PO Harijt Singh arrived at the location to conduct State Liquor Authority (SLA) inspections. After finding numerous violations it was determined that the bar would close early for the evening and patrons sent home. [redacted] alleged that she had been sober that evening and was prepared to take a cab home once she moved her vehicle to a better parking spot and approached PO Perez and Sgt. Zegilla requesting permission to do so before leaving the location, which she claimed they granted. As [redacted] was moving her vehicle, occupied by [redacted] and some of her other friends, the officers pulled her over and instructed her that she would have to take a breathalyzer test. [redacted] went to the rear of the vehicle to take the test and after multiple attempts the mechanism still failed to yield results. Sgt Zegilla and PO Fernandes forcibly handcuffed [redacted] and arrested her for drunken driving (Allegations A and B). When [redacted] refused to exit [redacted]'s vehicle which was to be vouchered pursuant to her arrest, he was placed under arrest and PO Fernandes, PO Peres and PO Singh used physical force against him (Allegations C-E).
