Summary

On April 26, 2006, at approximately 8 PM, [redacted] home, located at [redacted] were all at in Queens for a barbecue. [redacted] was sitting on the front stoop outside the house, talking with a neighbor, when officers pulled up in multiple vehicles to the location. An ESU officer then rushed at the neighbor and pushed him down to the ground, before he and two other ESU officers jumped on top of the neighbor and placed him in handcuffs. An ESU officer then ran to [redacted] grabbed her by her jacket, picked her up and threw her against a brick fence (allegation A). [redacted] fell to the ground and the ESU officer pointed his gun at her while instructing an officer from the 105th Precinct to handcuff her. [redacted] was allegedly searched by PO Hofelich and moved away while ESU officers broke down the front door to the house and entered the location with their guns pointed (allegation B). Detective John Conk, who was the first officer to enter the house, and some of the other ESU officers allegedly yelled at [redacted] who were all near the door in the living room and kitchen to "Get the fuck down" (allegations C and D). While [redacted] began to go down to the floor, [redacted] hesitated as to make sure that the officers did not harm [redacted] his mother. An ESU officer approached [redacted] and hit him in the face with his shield, knocking [redacted] backwards onto a couch while yelling "Stay the fuck down and put your hands behind your back" (allegations E and F). That officer and a second ESU officer then grabbed [redacted] from the couch and pulled him down to the ground, where they held him down while placing him in handcuffs (allegation G).
