Summary

On June 14, 2006, at approximately 7:00PM, at the intersection of [redacted] Avenue and [redacted] Street in Manhattan, Officer Roberto Argaluza and Officer Johanna Urena pulled over the vehicle in which [redacted] and [redacted] were occupants (Allegations A and B). Officer Argaluza and Officer Urena approached the vehicle, and Officer Argaluza asked [redacted] to exit the vehicle, and to place his hands on the trunk. [redacted] complied, and Officer Argaluza frisked [redacted]s arms and wrists, and shook [redacted]s pants (Allegation C). Officer Argaluza also lifted up [redacted]s pant legs, felt inside [redacted]s socks, and searched [redacted]s pockets (Allegation D). Officer Argaluza then searched the vehicle (Allegation E). Fifteen minutes later, Sergeant David Sanchez arrived at the scene, at which point Officer Urena took [redacted] out of the vehicle, and frisked and searched her (Allegations F and G). Officer Argaluza searched the vehicle again, at which point he discovered an inch-long marijuana cigarette. Officer Argaluza then handcuffed [redacted] and [redacted] and Sergeant Sanchez told the officers to place [redacted] and [redacted] into the waiting police van.
