On August 5, 2006, at approximately 11:45 AM, [redacted] was at his house at [redacted] in Queens when he heard shots being fired. After the shots stopped being fired, he went outside to see what had occurred. After several minutes, several officers arrived in several police vehicles. PO Joseph Bentivegna and PO Michael Carleo of the 113th Precinct arrived in one of these vehicles and they pulled over near [redacted] As soon as PO Carleo exited the police vehicle, he ordered and an individual to stop (Allegation A), pointed his gun at [redacted] (Allegation B), used force to stop him (Allegation C), pulled out his asp (Allegation D), and frisked him (Allegation E).
