Summary

On August 28, 2006, at approximately 7:30 p.m., [redacted] and his wife, [redacted] were picking up their daughter from the babysitter's house at [redacted] in Brooklyn. They left their keys in the ignition of their car. When they returned to the car with their baby, PO Kaz Daughtry of the 73rd Precinct and PO Christophe Kirchoff of the same command were standing by it. PO Daughtry asked [redacted] and [redacted] if it was their car and they responded that it was. PO Daughtry asked for [redacted]'s ID (Allegation A). PO Daughtry pushed [redacted] against the car and handcuffed him (Allegation B). PO Daughtry went into [redacted]'s pocket and retrieved his wallet (Allegation C). PO Daughtry went into the driver's side of [redacted]'s car and pulled up the carpet (Allegation D). [redacted] was not arrested but was issued a summons for [redacted].
