At 12:45 a.m., [redacted] was with his girlfriend, [redacted] and parked his vehicle on the corner of East 221st Street and Oakley Street in the Bronx. [redacted] exited the vehicle first and walked towards [redacted] home, which is located at [redacted]. [redacted] who was dressed in a hooded sweatshirt, crossed the street to follow [redacted] when a gold Chevrolet Impala stopped near him and three plainclothes officers, identified from the investigation as PO Michael Raso, PO Luis Alemany and PO Levar Stockton, approached him. PO Alemany instructed [redacted] to take his hands out of his pocket then PO Alemany and PO Raso allegedly grabbed [redacted] by his hands (Allegation A). PO Alemany and PO Raso allegedly pushed [redacted] towards the rear bumper of the Impala. PO Raso allegedly kicked [redacted] in the inner-thigh of his left leg (Allegation B). PO Raso frisked [redacted] and allegedly reached into [redacted] pockets and removed his cell phone, keys and license (Allegation C). When [redacted] asked the officers if he looked like a thief, PO Alemany allegedly responded, "Yeah. You look like a thief. Shut the fuck up" (Allegation D). PO Raso allegedly told [redacted] "I should smash your face into the windshield" (Allegation E). PO Stockton did not interact directly with [redacted] but spoke to [redacted] who remained in the area. PO Raso issued [redacted] a summons and the officers left the scene.
