At approximately 12:10 a.m. on September 24, 2006, [redacted] who is handicapped and could not walk at the time, was in the front passenger seat of a car his cousin [redacted] had double-parked in front of a Jordan's Barbershop at 1354 E.L. Grant Highway in the Bronx while waiting for a parking space. There was a party in front of the barbershop and officers were clearing cars out of the area. PO Tiffany Dozier instructed [redacted] to move the car, which he did, but he returned immediately, and PO Dozier again approached the car, at which point [redacted] stated that they were about to park. PO Dozier then called [redacted] a "smartass" (Allegation A) and issued a double-parking summons. Sgt. Osvaldo Nunez approached during this time and became involved in the dispute with [redacted] girlfriend, [redacted] who was standing on the sidewalk at the time, then asked Sgt. Nunez for his shield number upon [redacted] request, which Sgt. Nunez provided verbally along with his name. He then approached the car and pushed past [redacted] on the way, knocking her into the car, (Allegation B). He then stated to [redacted] "You're fucking with the wrong cop. Now you're going to jail," (Allegation C). [redacted] explained that he had a spinal cord injury and could not walk, and Sgt. Nunez handcuffed him and dragged him out of the car by his arms. [redacted] and [redacted] began protesting and requesting that the officers be careful with [redacted] Sgt. Nunez then lifted [redacted] by his arms and PO James Gonzalez and another officer helped carry [redacted] to a police van and place him inside. [redacted] complained that he was in pain and that he could not walk, and Sgt. Nunez stated, "I don't give a fuck if you can walk or not," (within Allegation C).
