On August 12, 2006, [redacted] and his fiancé, [redacted] attended her friend's birthday party from which [redacted] left first, returning at 5AM on August 13, 2006, to [redacted]s apartment, located at [redacted] in Manhattan. When [redacted] came home at 6:55AM, she rang the doorbell. Because the lock is "faulty" [redacted] was unable to open the door for her; she thought that he had intentionally locked her out. [redacted] and her unidentified friend yelled at him to open the door, saying, "He doesn't have squatter's rights!" The lease to the apartment is in [redacted]s name; [redacted] has lived there for seven years, and in his CCRB interview he explained that he and [redacted] often joke about him being a squatter. [redacted] then told [redacted] to call the police and ask the superintendent, [redacted] to open the door. [redacted] was able to unlock the door after 2-5 minutes of working with the lock. [redacted] barefoot and wearing a gray valor sweat suit, went into the hallway of the building, where he and [redacted] immediately began arguing.
As [redacted] tried to get [redacted] and [redacted] to move their argument to [redacted]s apartment, PO1 (identified through the investigation as PO William Mattocks) entered the 2nd floor hallway of the apartment building, and [redacted] realized that [redacted] must have called the police. Only 15-20 minutes had passed since [redacted] had arrived at the apartment. Although in his phone statement [redacted] was only able to describe PO Mattocks as a Black male officer with an afro, in his CCRB statement he added that PO Mattocks was about 30 years old, 5'11" tall and 185 lbs.
PO Mattocks asked [redacted] a few questions (he did not recall the content of those questions) and [redacted] showed him some papers. In his CCRB interview, [redacted] admitted that [redacted] had an order of protection against him at one point.
