Summary

On October 23, 2006, at 6:20 PM, police officers assigned to the 46th Precinct SNEU (Street Narcotics Enforcement Unit) entered the lobby of [redacted] in the Bronx. An unidentified officer approached [redacted] who was standing in the lobby, and allegedly put his arms around [redacted] s neck, brought him to the ground and punched [redacted] in the face (allegation A) before handcuffing him. [redacted] told the unidentified officer that the handcuffs were too tight, and the officer allegedly responded, "Shut the fuck up" (allegation B). [redacted] was then escorted to the prisoner van. Inside the prisoner van, the unidentified officer allegedly punched [redacted] in the stomach (allegation A). [redacted] s girlfriend, [redacted] entered the lobby and told her son, who was in the lobby after returning from the store, to come upstairs with her. An officer identified as Officer Frederic Ortiz allegedly told her, "No one told you to send your fucking [redacted] year old son to the store" (allegation C).
Officer Ortiz and two other officers, identified as Officer Edward Garcia and Sergeant Jerome Perry, went upstairs to apartment where [redacted] lived with [redacted]. The officers spoke with [redacted] and she told them that they could enter the apartment. The officers then entered and searched the apartment (allegation D).
