Summary

On February 10, 2007 at approximately 6am, [redacted] s wife, [redacted] called the police to have [redacted] escorted from their residence on [redacted] in Far Rockaway, Queens. [redacted] did not know his wife called 911 and did not know the reason why his wife wanted him escorted from their home. [redacted] let the officers into the apartment. Two officers, determined through the investigation to be PO Gary Lin and PO Carlos Segovia, entered into the apartment. PO Lin and PO Segovia were talking with [redacted] and [redacted] stood between PO Lin and PO Segovia. The officers were talking to [redacted] but [redacted] could not recall what they were saying. [redacted] s bag was next to his wife and he grabbed it. PO Lin and PO Segovia each grabbed one of [redacted] s arms. One of the officers whom [redacted] could not remember told [redacted] "Shut the fuck up!" [redacted] told PO Lin and PO Segovia not to talk like that in front of his two young daughters, who were standing next to his wife. [redacted] must not have shut up fast enough because PO Lin hit him in the legs with a black stick. [redacted] attempted to move his hands so he could block the hits to his legs. A "tussle" ensued between [redacted] and PO Lin and PO Segovia. [redacted] PO Lin and PO Segovia all fell on the ground. PO Lin and PO Segovia threw [redacted] on the couch and PO Lin kept hitting [redacted] on the hand with the stick. PO Segovia kept telling [redacted] to let the officers cuff him. [redacted] kept saying that he did not want this to happen in front of his daughters. At this point other officers knocked on the door and [redacted] let the officers inside the apartment. [redacted] was on the couch when PO Lin and PO Segovia handcuffed him.
