On March 6, 2007, at approximately 7 pm, [redacted] briefly entered a liquor store at the corner of St. John's Place and Albany Avenue in Brooklyn and then returned to his car, turned the corner and parked, and exited the car with his girlfriend, [redacted] Officer Maribel Sarante, working as the Observation Post of the 77th Precinct SNEU team, had been observing him and believed him to have engaged in a drug transaction, and she reported a description of him to the other SNEU officers she was working with (Allegation A). Officers Eddy Linares and John Acconi responded, stopping [redacted] and [redacted] on the street and approaching [redacted] to search and arrest him. [redacted] resisted being searched or arrested, and when Officer Linares called for backup, Officer Nicholas Tricarico and Sergeant Steven Talvy arrived. [redacted] physically resisted arrest and [redacted] tried to interfere with the officers who were struggling with him, and Officers Linares, Acconi, and Tricarico used physical force against [redacted] (Allegations B, C, and E), and Officer Linares struck [redacted] several times in the leg with his baton (Allegation D). Officer Linares pushed [redacted] back (Allegation C) and Sgt. Talvy used minor physical force to try to keep [redacted] away from the vicinity of [redacted] and to arrest her when she continued trying to get to [redacted] (Allegation F).
