Summary

At approximately 9:45 PM on February 28, 2007, [redacted] was driving with four friends in his green 1995 Nissan Quest mini-van. They were headed to one of the men's houses when they were pulled over by a marked RMP [Allegations A, B, and C]. PO Mack Lipinski and PO Jennifer Lavelle, both of the 75th Precinct, approached the vehicle. The officers ordered the three men in the rear of the vehicle, [redacted], and a man known as [redacted] to get out of the vehicle and led them to the rear of the van. An officer searched [redacted] s shoe, and when [redacted] was ordered out of the van, an officer searched him and found a bag of marijuana [Allegation DJ. PO Lipinski ordered [redacted] out of the van, frisked him, and searched his pockets [Allegation E]. PO Lipinski and another officer then searched [redacted] s van without finding any further contraband [Allegations F and G]. [redacted] alleged that, at some point during the incident, PO John Chiam told [redacted] to "Shut the fuck up" [Allegation H].
Only PO Chiam, [redacted] s arresting officer, claimed to remember the incident. He stated that he, PO Lipinski and PO Lavelle – all of whom were assigned to a SNEU chase car - stopped [redacted] s van because officers assigned to an observation post had transmitted a description of the van and [redacted] after observing [redacted] purchase drugs.
