Summary

On April 19, 2008 at approximately 4:30pm, [redacted] were smoking marijuana in front of [redacted] in Brooklyn. At that time, PO John Acconi, PO Steven Margaritis, PO Maribel Sarante and PO Joseph Tillotson, all of whom were assigned to the 77th Precinct, were driving by and noticed them smoking marijuana and decided to arrest them. The officers exited their vehicle and approached [redacted] alleged that several of the male officers had their guns drawn (Allegation A). [redacted] fled towards the house at the sight of the officers, but [redacted] stayed where he was and blocked the path of the officers attempting to apprehend [redacted] PO Tillotson and PO Margaritis got past [redacted] and ran to the door that [redacted] had just gone into. Since they had locked the door, PO Tillotson broke through the door by kicking it in and knocking it off the hinges (Allegation B). PO Tillotson and PO Margaritis then entered and searched the house for [redacted] (Allegations C and D); it was also alleged that PO Sarante entered and searched the house at this time (Allegation E). Inside the house, [redacted] relatives of [redacted] alleged that PO Sarante had her gun pointed in their general direction (Allegation F). As PO Tillotson and PO Margaritis searched for [redacted] inside the house, [redacted] both of whom resided there, became engaged in verbal confrontations with the officers. [redacted] began protesting that the officers were not allowed to be inside the house without a warrant, and alleged that PO Margaritis said things such as, "Shut the fuck up," and, "I can do whatever the fuck I want," (Allegation G).
Outside, PO Acconi, PO Sarante and PO Margaritis allegedly struggled with [redacted] who was resisting arrest.
