Summary

On May 16, 2007, at approximately 12:45 PM, officers received a call regarding shots fired in the basement of [redacted] in the Bronx. [redacted] was in this basement with his friends, [redacted] and [redacted] when police officers came downstairs with guns drawn and pointed (Allegations A, B, C, D and E). Sergeant Roberto Santiago pointed his gun at all the males and allegedly said, "I'll shoot you if you don't get in the floor" (Allegation F) and "Get the fuck on the floor" (Allegation G). SGT Santiago allegedly threw [redacted] on the floor and put his foot in [redacted] back (Allegation H). Officer Maria Reyes came into the basement with SGT Santiago. Lieutenant Fernando Guimaraes pointed his gun at [redacted] (Allegation D). Also on the scene were Officer Philip Connor, Officer Leslieangi Salcedo and Officer Nathaniel Anthony. The officers threw all the males on the floor and had all the males in handcuffs for 15-20 minutes. The officers searched the basement (Allegation A). While handcuffed on the floor, the officers frisked the males (Allegation J). LT Guimaraes frisked [redacted] in the pants pockets area and a different officer (the investigation could not positively identify this officer) allegedly stuck his hands inside [redacted]s front pockets and back pockets (Allegation I). The officers released the males from the handcuffs and left the basement shortly after the handcuffs were removed.
