[redacted] who was arrested under the name [redacted] was interviewed by Detective Vincent Bellizzi of IAB on June 16, 2007 (Encl. 7A-C). At that time, he stated that he had driven away because [redacted] told him to, thinking they were about to be robbed. [redacted] alleged only that he was kicked and punched while on the ground. [redacted] did not recall hitting his head against the glass and stated that he could not recall the incident because he had blacked out. Because [redacted] s primary language is Spanish but the interview was conducted in English, he did not provide Detective Bellizzi with any further information.
[redacted] was interviewed at the CCRB on July 16, 2007 (Encl. 9A-E). On June 15, 2007, [redacted] was sitting in his car, a 1992 green Honda Accord, with his friend [redacted] Although [redacted] did not know his friend's legal name, this individual was identified through arrest records as [redacted] They were parked on 188th Street and University Avenue near the Major Deegan Expressway and were planning a Father's Day party for the following day. They spoke to no one while in the car and no one came up to the car. A black Chevrolet Impala pulled up next to the passenger's side of [redacted] s car. There were four individuals inside, two white males, a Hispanic male and a female whose race [redacted] could not recall. [redacted] did not realize at the time that they were police officers and became scared, believing he was going to be kidnapped or attacked. Later in the interview, [redacted] explained that he had gotten paid that day and was afraid that he was going to be robbed. [redacted] proceeded to drive away and the black Impala followed him. He drove about a block and a half away and then the officers turned on the lights on the vehicle. [redacted] then realized they were officers and he stopped his car.
