On July 6, 2007 at approximately 9:00am in front of [redacted] in the Bronx, [redacted] was outside with his friend, [redacted] PO Nicolas Dipardo, allegedly grabbed [redacted] and dropped him on the ground. PO Dipardo allegedly placed his foot in his back and searched his pockets (Allegation A). [redacted] alleged that PO Dipardo stated, "You know what the fuck you were doing" (Allegation B). [redacted] and [redacted] were arrested and taken to the 43rd Precinct.
At the 43rd Precinct, PO Dipardo allegedly told [redacted] to "shut the fuck up" several times (Allegation C). [redacted] alleged that PO Dipardo then threw him into a door and he fell to the ground. PO Dipardo also allegedly kicked [redacted] in the ribs and stepped on his hand (Allegation D). [redacted] alleged that Lt. Fernando Guimaraes threatened him by saying, "Wait until you get in the bathroom" (Allegation E). Both [redacted] and [redacted] alleged that they were strip-searched by an officer at the precinct (Allegation F).
