On July 14, 2007, at approximately 6:30 p.m., Police Officers Wilson Alba and Ionut Gheorghiu observed [redacted] riding a bicycle on the sidewalk at [redacted] in the Bronx. While PO Gheorghiu and PO Alba were issuing [redacted] a summons, [redacted]'s aunt, [redacted] approached and asked what was happening. PO Alba allegedly told [redacted] "get the fuck back" (allegation A). [redacted]'s cousin, [redacted] approached and told the officers that the bicycle was too small for [redacted] to have ridden it. PO Alba allegedly responded, "Get the fuck out of my face. Mind your business" (allegation B). [redacted] began to walk away, but PO Alba grabbed him, picked him up, and threw him against a police truck (allegation C). PO Alba then allegedly put on a pair of black leather gloves and punched [redacted] in the face five to seven times. PO Alba took [redacted] to the ground and allegedly placed his forearm against the back of [redacted]'s head and handcuffed him.
