Summary

On June 24, 2007, [redacted] was waiting for food at a vendor stand on [redacted], in Brooklyn, with his friend, [redacted]. Another friend, [redacted] approached them and asked [redacted] if he had any cigarettes. [redacted] had cigarettes in a Jeep that belonged to his girlfriend, [redacted] and walked over to the car while [redacted] waited for his food from the vendor. [redacted] retrieved the cigarettes from inside of the car, gave them to [redacted] and locked the car. [redacted] walked away from the vehicle when they were approached by PO Mark Jablonski and PO John Tancredi of the 67th Precinct [Allegations A and B]. PO Jablonski attempted to converse with [redacted] who responded that he did not speak with police officers. [redacted] voluntarily handed PO Jablonski his driver's license and agreed to be frisked by him.
PO Tancredi allegedly frisked [redacted]. PO Tancredi asked [redacted] if he could frisk him and [redacted] agreed. PO Tancredi allegedly frisked [redacted] and felt keys in his pocket, which he removed [Allegation C]. PO Tancredi told PO Jablonski to handcuff [redacted] and [redacted] which he did. PO Tancredi then approached the car and looked into the Jeep, where he saw a firearm in plainview on the floor. The officers informed both men that they were under arrest. [redacted] approached the officers and asked them why they were arresting [redacted] and [redacted]. PO Tancredi told [redacted] that it was none of his concern and instructed him to step back. [redacted] continued asking what the charges were against them. PO Tancredi allegedly pulled out his gun and pointed it at [redacted] [Allegation D]. Then, PO Tancredi allegedly stated, "Get the fuck back. I'll shoot me a nigger tonight." [Allegations E and F] [redacted] started dialing a telephone number on his cellular telephone and alleged that PO Tancredi smacked the phone from his hand and broke it [Allegation G].
