Summary

On June 30, 2007 at approximately 4:10pm, [redacted] was in his bedroom at his residence [redacted] listening to music. His wife, [redacted] and his [redacted]-old grandson, [redacted] were the only other people who were home at the time-both were in the living room watching a baseball game on television. Earlier that day, [redacted] had consumed approximately three to four beers, and he was slightly intoxicated at the time. He also explained that he has problems with his memory and does not easily remember faces or other physical attributes of people. [redacted] explained that the window in his bedroom faces [redacted], and that on that date, [redacted] had parked his van on the side of the street. [redacted] never heard any commotion outside his window at any point that day, and he never heard any glass breaking outside. While he was in his bedroom, [redacted] heard a knock at the front door, so he went to see who was there. When he opened the door, he observed two police officers standing in the hallway. [redacted] identified one officer as having the last name "Noor," which he obtained this from the officer's nameplate. (These officers were identified through investigation as PO Misbahul Noor and PO William Fields, both of the 70th Precinct). PO Fields asked [redacted] if he and PO Noor could enter the apartment. When [redacted] asked why, PO Fields replied that [redacted] had accused somebody in his apartment of something. [redacted] could not remember if PO Fields told him the specifics of the accusation at this time or if he told him later during the incident, but at some point, PO Fields told [redacted] that [redacted]'s grandson, [redacted] of breaking one of the windows of his van).
