Summary

On February 27, 2008, at approximately 6:20 PM, [redacted] was parked in front of [redacted] in Staten Island. His acquaintance, [redacted] was seated in the front passenger's seat of his vehicle. Officers suddenly approached both sides of [redacted] vehicle with their firearms drawn (Allegation A). An officer, identified through the investigation as Det. Michael Rivera from Narcotics Borough Staten Island, allegedly pointed his firearm at [redacted] (Allegation B). [redacted] alleged that Det. Rivera pulled him from his vehicle (Allegation C), secured him in handcuffs (Allegation D), and then pushed him onto the hood of his vehicle (Within Allegation C). [redacted] refused to exit [redacted] vehicle. [redacted] alleged that officers told him to 'get the fuck' out of the vehicle (Allegation E). [redacted] alleged that he was pulled from [redacted] vehicle (Allegation F) and handcuffed (Allegation G) by an officer identified through the investigation as Det. Steven Sposito of Narcotics Borough Brooklyn North. [redacted] alleged that an officer then struck him twice in the face (Within Allegation F) and told him to 'stop eye-fucking me' (Within Allegation E). [redacted] alleged that officers brought him to the rear of [redacted] vehicle, punched him repeatedly, bodily lifted him into the air (Within Allegation E), and told to 'shut the fuck up (Within Allegation E). An officer, identified through the investigation as PO John Brooks of Narcotics Borough Staten Island, allegedly pointed his firearm at [redacted] at this time (Allegation H).
