On March 20, 2008 at approximately 7:10 PM, [redacted] was driving eastbound on Gunhill Road in the Bronx when he was pulled over by SGT Louis Deceglie, PO Michael Raso, PO Luis Alemany and PO Gennaro Russo. After asking the officers if he was being racially profiled, SGT Deceglie allegedly grabbed [redacted] through the front window with his left hand and with his right hand pulled [redacted] by the right shoulder and collar (Allegation A). PO Raso also reached through the front window and grabbed [redacted]s left hand and pulled [redacted] out of the vehicle (Allegation B). SGT Deceglie placed [redacted] in handcuffs and removed [redacted]s wallet from his pocket and extracted his license. He allegedly took [redacted] around to the back of his vehicle and slammed him face down into the back of the car, saying, "You're lucky its daylight out here or I'd slam your face into this fucking glass" (Allegation C). An unidentified officer allegedly kicked [redacted]s legs out from under him, causing him to fall back onto the ground. SGT Deceglie pulled up his shirt, revealing a gold badge and allegedly said, "I'm the supervisor motherfucker." He allegedly told [redacted] "Shut the fuck up or I'll kick you in your fucking face. You're nothing but a black piece of shit" (Allegation D). During this time, PO Russo and PO Alemany allegedly searched the interior of the vehicle, including the trunk (Allegations E and F). According to officer testimony, PO Raso searched the area around the front seat after [redacted] was removed from the vehicle (Allegation G).
