Summary

On March 24, 2008, at approximately 9:30 PM, [redacted] was with his friends, [redacted] and [redacted] in the [redacted] a Trespass Affidavit Program building located on [redacted] in Brooklyn. [redacted] entered his apartment, within the [redacted] and [redacted] and [redacted] remained in the courtyard. Shortly after [redacted] entered his apartment, Officer Stephen Sheppard, of the 73rd Precinct, approached [redacted] and asked what he was doing there [Allegation A]. [redacted] responded that they were waiting for a friend. Officer Sheppard continued to ask additional questions concerning what their reason was for being in the area. [redacted] stated that he began to walk away and Officer Sheppard followed him. Officer Sheppard stated that he wanted to speak with [redacted] began to cross [redacted]. As he was crossing, he saw a car approaching and began to jog across the street. Officer Sheppard ran after him and when he caught up to him, Officer Sheppard placed one hand on the back of [redacted]'s neck and pushed him into a wall. With his other hand, he grabbed [redacted]'s arm and pulled it behind his back to place his wrist in a handcuff [Allegation B]. Officer Sheppard then pushed [redacted] to the ground, and cuffed his other wrist. [redacted] stated that multiple officers then responded to the location and began to punch and kick him while he was handcuffed on the ground [Allegation C]. [redacted] stated that he then was lifted off the ground and escorted to the prisoner van by an officer. The officer took [redacted]'s head and hit it against the side of the police van [Allegation D].
