Summary

On April 16, 2008, at approximately 4:30 PM, [redacted] parked and exited his grey-blue Honda Pilot SUV near the intersection of [redacted] in Manhattan. [redacted] began speaking to [redacted] and walked eastbound. In front of [redacted] a Manhattan South Narcotics team consisting of PO Frederic Ortiz, Lt. Ernest Lungaro, Det. Anthony Bombolino, Det. Frank Altieri, Det. Joseph King, Det. Bennie Vance, and PO Jason Nachtrab stopped [redacted] and [redacted] (Allegations A and B). The officers searched the two individuals and then placed them under arrest. During the search, [redacted] approached [redacted] Det. Bennie Vance told [redacted] to "Get the fuck back" (Allegation C) and said, "If you don't shut up you can go to jail too" (Allegation D). Det. Vance then asked [redacted] to lift her shirt and empty her pockets (Allegation E). Det. Vance also probed the embroidered design on [redacted] back pocket with his finger. Officers recovered marijuana on [redacted] person. PO Ortiz proceeded to search Honda SUV in which [redacted] had been an occupant (Allegation F). The officers under Lt.
