Summary

On April 15, 2008, at approximately 10:00 AM, [redacted] was in Washington Square Park in Manhattan. He spoke with another individual and then tried to leave the park, when Detective Erik Ruiz, assigned to Narcotics Borough Manhattan South, approached him and grabbed his coat. Detective Shawn Gordon, also assigned to Narcotics Borough Manhattan South, then handcuffed him. Detective Ruiz began to search [redacted]'s coat and Detective Robert Numssen, assigned to Narcotics Borough Manhattan South, searched his pants, waistband, socks, and boots. [redacted] stated that Detective Gordon also searched his waistband then and opened the button to his fly and placed his hands down [redacted]'s boxers near his anal cavity [Allegation A]. [redacted] stated that he moved away from the detective, though, so his anal cavity was not entered.
[redacted] was transported to the 6th Precinct stationhouse and taken into the bathroom to be searched by Detectives Gordon and Numssen. When [redacted] refused to remove his metal chains and gold teeth caps, Detective Gordon lifted his arms, as they were still handcuffed, past his joint and stabbed the palm of his right hand with a sharp object, which [redacted] believed to be a key [Allegation B]. [redacted] then attempted to stand straight up and Detective Numssen punched the back of his head [Allegation C]. [redacted] stated that he was then handcuffed to a bench outside of the holding cell. He stated that he asked Detective Ruiz and Officer Ortiz for their names, but they did not provide them [Allegations D and E].
