On June 7, 2008 at approximately 12:00 PM, [redacted]'s vehicle was stopped in the vicinity of Barnes Avenue and East 229th Street in the Bronx for a broken brake light. [redacted]'s friends [redacted] and an individual known only as [redacted] were also in the vehicle. Four officers in plainclothes approached the vehicle. PO Patrick Jean of the 47th Precinct allegedly told [redacted] to "Shut the fuck up" (Allegation A). PO Robert Roda of the 47th Precinct allegedly opened the driver's side door of the vehicle, pulled [redacted] from the vehicle, and pushed him, back first, against the vehicle (Allegation B).
