[redacted] stated that at approximately 11:00 AM on June 17, 2008, he was driving with a friend, [redacted] along Park Avenue and East 161st Street in the Bronx. [redacted] had his music on and drove past a marked police van in which there were four officers, identified through investigation as PO Robert Klein, PO Jonathan Rivera, PO James Cruger and PO Robert Taylor. When [redacted] drove by, the officers indicated to [redacted] to pull over.
[redacted] stated that during his interaction with the officers, PO Klein told him, "Turn that shit off!" in reference to his playing his music and "You can look at my badge number. I don't give a fuck" (Allegation A). After this, [redacted] threw a straw that he had in his mouth at PO Klein and proceeded to exit his car despite PO Klein's command for him to stay inside. [redacted] was arrested for [redacted] refused to provide any identification to PO Klein and thus [redacted] Is car had to be taken into custody for safekeeping. [redacted] then alleged that officers, determined through investigation to be PO Cruger and PO Klein, searched his car without probable cause (Allegations B and C). [redacted] added that as a result of the search, his car sustained damage to the back seat leather upholstery covering and the horn on the left side (Allegation D).
