Summary

On July 2, 2008 at approximately 7:55 pm, [redacted] exited the Crescent St. Subway station in Brooklyn and observed PO Daniel Barreto of the 75th Precinct patting down an unidentified motorist. The motorist was yelling and using profanity and a crowd of passersby had gathered on the sidewalk. When [redacted] saw an unmarked car approaching the area, he became concerned for the motorist and approached him in order to tell him to calm down. [redacted] reported that the motorist heeded his advice and their interaction lasted less than one minute. [redacted] was walking away from the scene when PO Jennifer LaVelle, also of the 75th Precinct, exited the unmarked car, approached him, and asked if he knew the motorist. [redacted] replied no, and PO LaVelle allegedly said "Then get the hell outta here" (Allegation A). PO Lavelle then allegedly elbowed [redacted] in his right ribs (Allegation B). [redacted] left the area before the motorist was issued any tickets or had any further interactions with the officers. [redacted] was not arrested or issued any tickets, and he did not sustain any injuries.
