Summary

On July 15, 2008, [redacted] turned herself in to the 120th Precinct stationhouse where she was arrested for assault. Around 10:00 AM on July 16, 2008, [redacted] was inside a holding cell in the 120th Precinct stationhouse. She expected that she would be transported to the courthouse that morning, but when she learned this would not take place, [redacted] became upset. She began to yell, curse, flooded her cell, and broke apart a wooden bench. Several officers, identified through investigation as PO Nancy Heinz, PO Eric Dym, PO Derek Epstein, and PO Sgt. Pernicone responded to the cell area. [redacted] alleged that PO Dym punched her in the face (Allegation A), and PO Epstein kneed her in the nose (Allegation B). [redacted] stated that PO Dym referred to her as, "black bitch", "animal", and "asshole", (Allegation C), PO Heinz called her, "bitch" and "fucking animal", (Allegation D), and PO Epstein said, "She bit me, she's an animal", (Allegation E).
[redacted] also alleged that all of the officers present kicked her (Allegations F, A and B) and that PO Dym picked her up by the waist of her jeans and dropped her on the ground (Allegation G).
